Rock, Hammer, whatever lethal instrument, the perp set the force level. The fact the he was an illegal Mexican has no bearing here. I don't believe the LE should have to figure demographic factors in his decision.
In Ohio the standard is;
1) Do the actions the person, either through method or persistence, pose a significant risk on inflicting serious injury or death.
2) Does the potential victim reasonably believe the aggressor posses a significant risk of serious injury or death through his actions.
