I think that the first order of business should be to have a town hall meeting in a venue that will hold say 60000+ folks. Reach out the olive branch so to speak, let anybody who apposes the bill attend and voice their concerns. Once they are all there we can round them up and send them packing.

It needed to be done. If only a common sense approach to cheap labor was implemented and enforced 30 years ago everyone on both sides of the border would have been much better off.

Keep the pressure up... vote out the National incumbents, none have made a difference, best that can be said is they stalemate... total change is needed.

Good question. I lived in Denver for a couple of years, and visit my brother there every summer. Illegal aliens come from all over the world. But, you would be surprised how unsympathetic some Hispanics are towards the undocumented, the economy and the drug violence do not help. Cluster [bleep].

Things like this from 2008 make me think that it will be catch & release with illegals who get picked up for speeding or any other local misdemeanor - or who haven't been convicted and served time yet.

I think it's about time the feds learned on very important lesson. They're not in position to screw the states, unless they're willing to declare and carry out Civil War II.

they don't hold all the purse strings. Only the ones where new money creation is concerned. The REAL funding comes from the hard woking people. If the feds try to trump any or all of the states all the state has to do is say no more IRS allowed within our borders. Get lost! go back home to DC and stay there!

Under certain conditions they can deport them without a hearing- if they are only in the country so many days and within so far of the border- don't remember the particulars.

Worked at the ICE prison in Florence for 6 months transporting them to Mexico by bus and to airport for the CON-AIR flight to central america. A lot of the Border Patrol pickups would be dropped off and staged for a flight the next day!

Dennis is right. Many times there is no hearing, just either deportation or catch and release at the border. I believe multiple apps and/or crimes committed and they get the judge, other than that they are deported or voluntary returned(catch and release).

I think its gonna be a busy summer and end of the year.

there has been some pretty interesting dialoge the last few days. Most of your la raza types saying pretty much what you would expect. Racist, hateful, etc. Systema, the blonde idiot was playing for headlines, the law will never stand, multiple lawsuits etc. Bam Bam is already trying to get milage off of it, a law passed by misguided people due to the failure of the government to pass amnesty.
There was a young girl, one of the demonstrators interviewed, she was really upset. Seems BOTH her parents were illegal, and she didn't know what to do, they might have to move to another state, or, horrors, back to mexico. You see this is all racist, or so the spin goes.
The head of the law enforcement organization PLEA, if i remember right, was on too. He mentioned six points covered by the bill, all of which were already available. The KEY focus of this bill is to disallow sanctury cities, and inaction by various chiefs that were NOT enforcing the law.
For various reasons there were items specifically written into the bill to guarantee against profiling etc.

There were also, by the way, hispanics calling in to the radio station in SUPPORT of the bill. The radio stated about 90% of the demonstrators by the way were schoolchildren that you could bet did not understand the bill, but were being guided by various groups.
You could see the alinsky hand in this, in they were playing for the media, even to the point of bussing in people from california.
It will be curious to see what happens. I think something like 70% in hard numbers of arizona support this bill. If it is dehorned by the feds/obama, or judges, I think there will be a next step but don't really want to guess what that would be.

Not sure I follow that line of thinking. The mexicans that currently bring in the drugs and take billions of US dollars back to mexico, where they fortify and advance their narco terrorism, would be out of business and out of money. People in America, mexican or american, are going to use the drugs whether it's legal or not. There's no stopping them so why bother trying?

How does legalizing drugs pander to mesican nationals living legally or illegally in America? It'd pull the rug out from beneath their lawlessness, how would that gain votes from mesicans? Besides, illegal voters from mexico would be signed up to vote by ACORN and probably not be voting for someone on a republican or independent ticket.

I work for ICE so can answer your questions. Most illegals are picked up as a result of their being locked up someplace and the locals calling and saying they believe they have someone illegal. It does not matter what the crime is - it can be speeding but is eight times out of ten, DWI or domestic violence. Once in ICE custody the alien is placed in removal proceedings. They can request to be returned to their home country without seeing an immigration judge, but most go before a judge. Some illegals have overstayed visas, but the ones from Mexico and other south/central American countries have normally crossed border illegally. If they have lived in this country for ten years and have a United States Citizen wife or children they can ask for a cancellation of removal hearing if they believe their removal would create an exceptional or extremely unusual hardship. They are also free to claim fear of return and ask for asylum, but they have to prove past persecution or a well founded fear of future persecution or torture. A normal removal hearing for a typical illegal alien last about 15 minutes including all his rights warnings. In the office I work for we remove about 35,000 a year.

I'm an Assistant Chief Counsel, which basically means I am an ICE trial attorney. I am in court virtually every day doing removal proceedings and a few times a week handling merits hearings for those aliens that are eligible for relief. You bring up a hot topic; the U.S. Supreme Court just handed down the Padilla case and it basically says that aliens are entitled to be advised of the immigration consequences of a conviction or plea agreement. Failure to at least inform the alien that there may be some consequences and that they should seek out an immigration attorney for advice is grouds to have the conviction vacated. This decision is going to open the flood gates for motions to reopen based on ineffective assistance counsel. We are in the process of starting up a program to advise/inform state prosecutors of this decision.

I work for ICE so can answer your questions. Most illegals are picked up as a result of their being locked up someplace and the locals calling and saying they believe they have someone illegal. It does not matter what the crime is - it can be speeding but is eight times out of ten, DWI or domestic violence. Once in ICE custody the alien is placed in removal proceedings. They can request to be returned to their home country without seeing an immigration judge, but most go before a judge. Some illegals have overstayed visas, but the ones from Mexico and other south/central American countries have normally crossed border illegally. If they have lived in this country for ten years and have a United States Citizen wife or children they can ask for a cancellation of removal hearing if they believe their removal would create an exceptional or extremely unusual hardship. They are also free to claim fear of return and ask for asylum, but they have to prove past persecution or a well founded fear of future persecution or torture. A normal removal hearing for a typical illegal alien last about 15 minutes including all his rights warnings. In the office I work for we remove about 35,000 a year.

How much does this all cost, per head removed?
Legalities are damned expensive. Way too much so, in fact.

Might put some people out of work (or as I prefer to look at it, give them opportunity to do other things more productive) but it seems to me the best route is the cheapest route. Just round them up and ship them to the border, no questions asked and no answers needed. If they ain't legal, then they're illegal. Just ship 'em out and forget it. Why all this unproductive and wasteful screwing around with technicalities and legalities? For God's sake just ship them out and keep them out!!!!!!!

What's wrong with that?

I was on top of Padilla the day it was published on the web. It was decided a week after a PCR hearing on a non-citizen, and the judge hasn't ruled, yet.

Padilla was very, very narrowly ruled, though. It doesn't cover the issue of prejudice, as I'm sure you saw, and it doesn't cover a situation when the trial attorney has no actual knowledge that his client is not a citizen. (And that happens a lot. The defendant doesn't mention it and the attorney doesn't ask.)

The Supremes are going to have to address that soon, though, because a couple of days ago I got another PCR petition and the guy's PCR attorney not only cites to Padilla, but he says the guy's trial attorney didn't know. There's going to be more of these.

The local judges have caught on, though. Most of them are giving everyone an advisement on the record, including citizens.

They must be just using Kalifornia numbers. 10-12 MILLION dates back quite a while. Closer to 30-35 now.

I understand how you feel. If it makes you feel any better, almost all of the illegals that are caught at the border are fingerprinted and returned to Mexico without ever being put in immigration proceedings; however, the problem is, they come right back.

Also thousands of them that are caught in the interior U.S. ask for a voluntary removal and are returned without ever being put into immigration proceedings. The problem is there are millions of them and there are millions of them because employer want to hire cheap labor.

The Bee's will keep coming until you poison the honey pot, just the way it is. Burn the employers hard, make it stick, then they will stop comming so much. Then burn the DIY stores for the day workers they allow on their property, I hear they actually encourage those guys.
I agree with you crosshair. We have been burning lots of employers lately but there are just so many. If the incentive to work were taken away not as many would come. If not as many came, the U.S. Attorneys would also have time to enforce the current laws on the books that makes it a crime to be here illegally. Right now, they only look at those that have been deported and then re-entered again. Of course, they only prosecute a fraction of those.

It's the people who hired them, their state's voters, and they do what's best for the people who did hire them. Sometimes that is in conflict with the federal government.
But Jan Brewer, I think, in doing the right thing for her constituents and standing up for her state, and now it's a matter of working with the feds to kind of mesh what the mission is that they are on to make sure that this immigration reform that she wants to work on, that due respect is given to the state in this case.�
