Police Officers Called To School After 9-Year-Old Says The Word 'Brownies'

Police were called to a New Jersey elementary school after a 9-year-old student said, "Brownies," while talking about snacks, his mother alleged.

Another student reportedly misinterpreted the comment and thought it was said in a racist way, according to the Philadelphia Inquirer. A teacher subsequently called police.

“He said they were talking about brownies,” Stacy dos Santos, the child’s mother, said. "Who exactly did he offend?"

Dos Santos added that the incident has made her think twice about sending her child back to the school in the fall.

“I’m not comfortable with the administration; I don’t trust them, and neither does my child,” she said. “He was intimidated, obviously. There was a police officer with a gun in the holster talking to my son, saying, ‘Tell me what you said.’ He didn’t have anybody on his side.”

Officers also spoke to the children’s parents, and the incident was reported to the New Jersey Division of Child Protection and Permanency.

Collingswood Police Chief Kevin Carey stated during a meeting with school officials that they should report incidents to police, including cases “as minor as a simple name-calling incident that the school would typically handle internally.”

Police also said they were advised to refer almost every case to Child Protection and Permanency.

This policy was a shift from the previous one under the Memorandum of Agreement between the police and schools in New Jersey, under which incidents were reported only when deemed serious enough. Such action was typically taken in cases involving drugs, weapons or sexual assault.

Since the meeting, officers have been called to the school as often as five times per day.

“Some of it is just typical little-kid behavior,” teacher Megan Irwin said. “Never before in my years of teaching have I felt uncomfortable handling a situation or felt like I didn’t know how to handle a situation.”

The mayor, police and Camden County Prosecutor’s Office ultimately arranged a meeting to discuss incidents.

“In our discussion today, you and your staff made it abundantly clear that our recent meeting was to reinforce the applicability of the Memorandum of Agreement, but not to expand its terms,” Collingswood Mayor Jim Maley wrote in a letter to the prosecutor’s office, the Collingswod Patch reported.

the Supreme court has upheld that police interviews of a minor without the presence of consent of a legal guardian or attorney are inadmissible.
that being said the child was could not have been legally mirandized.
In short, the department should be sued and said "officer" dismissed summarily.
That's the only way to end stupid chit like this.

While I completely agree with your thoughts on the allergy angle, I do have to point out that there is no better way to ruin brownies (or fudge) than to stick walnuts or pecans in them. This is not only a matter of taste, but also addresses the fact that there never has been, nor will be, any such addition that did not include bits of the shell of either species.
Yes, technically NJ but sad to say it is Philly area nonsense (just across the river). What a mess - the adults/parents and folks who ran government and schools when we were kids there in the 40s and 50s were so far above such politically correct stupidity that it's difficult to imagine the transformation to that. Any PD or school official so irrational as to do such a thing back then would have gotten a triple earful of scorn and disdain from just about everyone in the community - for months. Most of the population then were hard-working serious people - many were immigrant families - and none would not have let go of that one. As an example, immediate and no-nonsense knowledgeable response is how the Philly sports fans got their great rep. It is almost impossible to believe that a PD would take such a position and enter into such a deal with "progressive" idiots. Shameful.

“The county and local law enforcement support that the school called the police,” Maley said. “What happened is not what’s being reported. Folks are looking at it, that’s all. And it’s reasonable.”

Oswald said that the stories that have emerged from that incident “couldn’t be further from the truth.

“It wasn’t a comment about a brownie at all in terms of offending an individual,” he said. “It was a comment that immediately rose to the level of an HIB [Harrassment, Intimidation, and Bullying] investigation.”

The superintendent acknowledged that third-grade students can “say things that need to be a learning experience,” but concluded that school staff “did absolutely the right thing by calling the police.”

Collingswood Board of Education President David Routzahn commented that “not only did administrators act properly, but they acted in a manner consistent with ensuring the health and safety of our students.

“We can’t discuss details of it, but I heard for the first time today what was actually said,” Routzahn said. “It is, as it says in the statement, much more incendiary than what is being reported. I was glad that the prosecutor’s office acknowledged that it was handled properly.”

I guess I choose to err on the side of caution.
You interview a minor without a parent, get a confession and tell me it's going to hold up in your courts?
That says a lot about your judges.
The worst attorney will get it tossed.
Read the decision, not just the news article.

Federally, any detainment is an arrest. A custodial arrest, but, an arrest. Does a minor feed the right to leave?
Then if questioned they must be mirandized.
What possible reason would any honest cop have for NOT advising someone of this rights.
NONE.
the only reason would be to use intimidation to get information that an attorney or parent would tell the minor not to give.
So if an officer is asking a question with the intent of charging the suspect with any crime then Miranda murst be given. And if you question one of my kids, your going to either do it or meet my attorney.

Sadly this is not impossible in today's climate.
It should please people to know that, just before his elevation to the Supreme Court, then Judge Gorsuch of the Tenth Circuit Court of Appeal filed a pithy dissenting opinion expressing disappointment at turning everyday school matters into police matters. A. M. v. Holmes, No. 14-2066 (10th Circuit 2016). We may see that again some day.

You may have passed on a good one - have met some wonderful ladies from S. Jersey. If they meet a great guy, most of them seem more than willing to leave there.
