Probably not in TX, at least if one can show they are a nuisance or health hazard (as in Roger's example)

Grackles are native to North America and consume a lot of insects. I see no more good reason to shoot them than any other native songbird.

Some States allow it, like dope, but the feds can still step in.

Like so many other things, it depends on the officer involved. It does bring up the question of precedence of law. Does a state statute over rule a federal one?

They nest in the Spring in a row of Hemlocks and tall shrubs by my house.

I used to shoot one or two with a pellet gun years ago and they would get the message and seemed to know they were being targeted. Smart like crows? I had an uncle who used to call them [bleep]-- birds smile

I don't plink them anymore as they seem to almost disappear after nesting. I don't think they are as destructive as starlings just don't have a pleasant sing song, kinda raspy....I've evolved into kinda liking them.

I may be incorrect but I think they were added to the migratory bird act as part of the same treaty with Mexico that added crows to the list.
