Probably not in TX, at least if one can show they are a nuisance or health hazard (as in Roger's example) Wild Birds: All wild birds that migrate through or are indigenous to Texas, along with their plumage or other parts, eggs, nests and young are protected from harming, killing and/or possession by state and federal law except that European starlings, English sparrows, and feral pigeons may be killed at any time and their nests and eggs may be destroyed. A permit is not required to control grackles; cowbirds; yellow-headed, red-winged, rusty or Brewer's blackbirds; crows or magpies when these birds are considered a nuisance or causing a public health hazard. Grackles are native to North America and consume a lot of insects. I see no more good reason to shoot them than any other native songbird.

I've always found it extremely difficult, ta distinguish tween starlings and gracks, when decidin ta pull the trigger.
Innocent mistake. Happened to me once. Ma said come shoot these starlings. Can't say no to your ma....right? Leastways no one has ever been convicted of war crimes when acting on orders from their mother. Was riding around town with a buddy later on and he spotted a big starling. He says...man...that's a nice grackle. Oh? Grackle huh? Yeah...thats a nice one.....

At least they run off the starlings. You have regular common grackles. We have great-tailed grackles, twice the size.

I like grackles.
At least they run off the starlings. You have regular common grackles. We have great-tailed grackles, twice the size. They just look big because you guys are a bit on the shorter side of things.

They nest in the Spring in a row of Hemlocks and tall shrubs by my house. I used to shoot one or two with a pellet gun years ago and they would get the message and seemed to know they were being targeted. Smart like crows? I had an uncle who used to call them [bleep]-- birds I don't plink them anymore as they seem to almost disappear after nesting. I don't think they are as destructive as starlings just don't have a pleasant sing song, kinda raspy....I've evolved into kinda liking them. MAGA!

I may be incorrect but I think they were added to the migratory bird act as part of the same treaty with Mexico that added crows to the list.
