The evidence has demonstrated that Mr. Claiborne
committed multiple violations of insurance laws in connection with the sale of annuities. Most

sale of an annuity was not unsuitable, Mr. Claiborne, on at least three occasions, recommended
the sale of annuities to elderly individuals without a meaningful assessment of their economic
circumstances. With regard to Ms. Holmes, Mr. Claiborne recommended the sale of an annuity

that resulted in an immediate loss of more than $2,000 and the potential for future lost interest
payments. With regard to the Woods, Mr. Claiborne recommended the sale of an annuity despite
having almost no information regarding the Woods‟s savings and investments. When Bankers
Life questioned the suitability of the investment, Mr. Claiborne altered a form which Mr. Wood
had previously signed as being accurate. When confronted about changes to the document, Mr.
Claiborne gave conflicting and increasingly self-serving answers.
With regard to the Holloway transaction, Mr. Claiborne recommended the sale of an
annuity that he knew would be funded primarily through the surrender of a variable annuity and
actively assisted Mr. Holloway in discussions with Prudential to secure the necessary forms
needed to complete the transaction. Mr. Claiborne made this recommendation despite the fact he
had never read the policy nor understood its unique and advantageous features for Mr. Holloway.
Despite his knowledge, Mr. Claiborne falsely indicated on Mr. Holloway‟s application that he
was not replacing an existing annuity, and did not plan on doing so. Mr. Claiborne offered no
reasonable explanation for his conduct, but falsely asserted that he was not aware of Mr.
Holloway‟s decision to surrender the Prudential annuity.
The evidence also established that Mr. Claiborne made false statements, as well as an
untimely response to the Division, including statements under oath, in an attempt to shield
himself from liability for his conduct. His statements to investigators were often self-serving,
contradictory, and contrary to all other available evidence. Given those false statements, the
Division can have no assurance that Mr. Claiborne will fully cooperate with any future
investigations that might arise. Mr. Claiborne has thus demonstrated a willingness to deceive
other insurance companies, the Division, and most importantly, the consumers, to serve his own
interests. Because the Division cannot rely on Mr. Claiborne to tell the truth, its ability to
effectively regulate his conduct to protect consumers in the future will be severely restricted.
Given the evidence in this matter, the ALJ concluded that the appropriate sanction is
revocation. ORS 744.074(1) allows the Division to revoke Mr. Claiborne‟s license. The
Division takes seriously its responsibility to protect the public from unscrupulous licensees. Mr.
Claiborne‟s license has already been suspended once for similar misconduct. (Ex. A1.) Given
his prior discipline and level of misconduct at issue here, the Division finds that the only
appropriate sanction is the revocation2
of Mr. Claiborne‟s license.



After reading this I am surprised that somebody hasn't either buried Safariman or left him laying in a ditch beaten within an inch of his life.


In the late 1980's a local insurance agent did something similar to the parents and grandparents of some pretty rough old boys.

A few months later they found him and his 17 year old son laying in a ditch as a result of being remodeled with a tire iron.

Last I heard about 15 years ago the crooked agent/dad was still in a rehab facility being fed intravenously because of the effects of the catastrophic brain damage.

The son still walks with a leg brace and is permanently disabled due to brain injuries.

No one has ever been found, arrested or charged for the beatings.

PS: my hip shot on a sideways moving , barely (bear-ly?) quartering but mostly broadside bear 350 yards out was made with my 338/8mm RemMag, not this rifle. I did not calculate his forward movement and how far he would travel shuffling along at a good pace before my 225gr TTSX bullet would arrive that far out. A little bit of big bear fever and excitement got to me and I muffed the shot. I make clean kills most of the time.

I admit that I should have remembered that Jack Huntington did the work on this, I just did not have that info at the top of my still addled brain when asked. In my world the last few years have been an eternity of paiin and exhaustion and Dr appointments and med's and..... My memory ain't all that hot, yet. And actually, I should have waited until I was off of high doses of prednisone and many other drugs that mess with my brain in addition to supressing my immune system before posting any ad. I will wait a while before posting an ad for anything for sale, and try to get all of it right going in. I go off of several really nasty drugs and prednisone (the worst offender) in Mid July.

RE my insurance coverage. I have a medicare advantage plan that has a maximum out of pocket for Part A (hospital and surgical) of $6500... My Transplant bill is $181,000 PLUS anesthesia, lots of follow up visits with specialists. I will owe the maximum $6500 on that, easily.

Then one of my anti rejection meds is NOT COVERED by my Medicare part D coverage at all. Part B coverage pays some on it, but my co pay for the first dose was $1400. I have the reciept for my first dose.

If anyone here wants to post the photos of these bills and reciepts, I can e-mail or text them to you. But 4ager was and is DEAD WRONG on the bills part and I can prove it.

The sale of this rifle is a big help to us right now, and I am NOT asking for any charity as we will be OK with what we saved up before the surgery and this sale.

And, you know for a fact that there are people here who know a lot about your dealings that haven't even come to light yet. You're really damned close to having some of those folks just drop the hammer on you, and yet you continue as if you're an innocent and never done anything wrong.

You keep up with the "God has a plan for me; I just have to figure out what it is" line. Well, here's a thought: how about starting with being truthful, answering for your transgressions, admitting them, and changing your ways?

Just a friggin' hint, and it's likely to be the last one. I, for one, have had it.

I'm very familiar with this rifle. Over 15 years ago, I bought it from my father but due to a nasty divorce in 2011, I had to sell off all my guns, this being one of the very last to go. When Mark bought it, I told him if he ever was looking at selling it, I wanted a chance to buy it back. After talking to Mark, he's agreed to sell it back to me for not too much over what he paid me for it.

In short, I'll take the gun.

That would be about the only rationale reason to deal with that con artist.

Glad you got that back in the family.

Odd, though, that he didn't just contact you first given his promise to you. Then again, there was potential profit to be made elsewhere. Go figure.

NW Rancher and I have dealt before, as buyer and seller several times and he is a good guy. I did not remember the offer to let him buy it back, but as soon as he called I honored the statement even though I do not remember making it. Fact is, I do not remember a lot of stuff from my pre renal failure years nor even much from during them. Been a little bit busy staying alive.

Plenty of folks here deal with me regularly. A known member here who does quite a bit of selling here just mailed me something today I commited to buy, without payment arriving. I just sent him his USPS MO. There are dozens of folks here who deal with me in this fashion, compared to maybe 1/2 dozen who like to try to firebomb my threads. Most of these posts, I ignore and so do the people who really know me and have dealt with me. I had several PM inquiries about this rifle, but am genuinely glad that NW Rancher is getting this back. To his home is where it belongs.

What do you have to say about your false statements regarding my real and true incoming medical bills, sir?
