The article of from Of Arms and the Law, by attorney David Hardy. David doesn't say a lot, but what he does say carries a lot of weight.

Long story short: There was a law allowing certain officials to appoint an Independent Counsel. It expired in 1999. Absent that law, Independent Counsel must be appointed by the President and confirmed by Congress. That is according to DOJ's own Office of Legal Counsel.

Meuller, of course, was appointed by DOJ.

Edited to add: He's a Special Counsel, not an Independent Counsel. Could be a false alarm.
