Sure they can. HIPAA prohibits disclosure of medical information a company has for an individual, it doesn’t prohibit someone asking you for your own.
And they can still deny you entry whether they ask or not, without violating HIPAA obviously. The ADA is the closest thing to what you people seem to want, which is the government to force private property owners to let you set the terms for using their place, but it covers only actual disabilities.
Many of you could probably get a clinical diagnosis of retarded, which would qualify you for ADA protections, but I’m not sure it would help on the mask front.
