Actually, it's 38 states. 50 x .75 = 37.5, rounded up to 38. 13 small states say no and it's dead.
It needs 2/3 of both houses before it gets that far.

There's no way 38 states are going to give up that much power.There will always be at least 13 states who would like their population to have a say in electing the President rather than letting New York and California dictate it.
