STAY AS FAR AWAY FROM HARRIS SPORTING LLC GUNBROKER SELLER( bbq05 )AS YOU CAN. THAT GUY RIPPED ME OFF ON A SHOTGUN. Sold me a rusted and pitted gun and told me over the phone that it was brand new in box. He also told me it was an 2006 model and it happened to be a 2001 . He blatently lied to me to get it off his shelf . When I called him up he told me to take it up with the manufacturer's warranty, that he would not suffer for their gun. so I call my credit card company to file a dispute but they want me to ship it back to him when I know he'll refuse it so it ends up as a big mess with me taking a piece of sh*t after he lied to me to sell it to me. BEWARE!!!! DO NOT BUY FROM HIM. I also did this deal outside of Gunbroker so there is no way to leave feedback. He's the lowest of low scumbag I've ever dealt with. Fellow gun buyer please take heed.

glad to know!!!! i was going to buy a browning citori white lighting 16 ga from them.... they also said it was 2006 model
but i found out browning hasn't made one in awhile....hope you get your money back....

Report both these incidents to Gunbroker! I've had desent luck getting them to block a seller from doing business on their site. Help out your buds now.

FYI: It does not matter that he refuses to accept the gun back. Legally what is important is that you "tendered" the gun to him (i.e. tried to return it.) I would ship it back and demand a credit from my card company. If you don't want to take the shipping hit, I would write him a letter telling him that you will hold it for a reasonable period of time (say 10 days) to allow him to arrange for pick up. Continue to place the charge in dispute and then request the credit. Also, don't overlook filing a complaint against his FFL with the ATF. There is no room in this world for crooks.

I have to say Gunbroker is absolutely terrible when it comes to complaints. I filed a complaint with them on a guy who sold me a $1900. shotgun with a cracked stock. I sent them all of the evidence they needed to see that he was guilty and they wrote me back and said "...we can see where he said the gun had no blemishes but he is getting good feedback now..." so if a guy only screws over some people and not all of them Gunbroker thinks they are all right then. <img src="/ubbthreads/images/graemlins/mad.gif" alt="" />

Then Gunbroker is out of the picture. If you tried to save a few bucks going outside of GB then shame on you. Post a picture of the gun for us to see. It is hard to get upset on this end knowing there are two sides to the story. A picture of a crappy gun will help convince me...

I think if you threaten the seller with legal action, and you have emails to back your story up, threaten them with legal action. It is easy to see where the rifle/shotgun came from so getting a good lawyer to draft the paperwork and take the seller to court would do wonders. First, they would have to travel to your state to attend court, and if you get your lawyer to put off the court date a couple times the first two times they show up for court, they are already in the hold for $800 in flight expense or hotel and meal expense. Then should you win (I am presuming a relatively good lawyer can prove the seller lied via emails or whatever), you also ask to be awarded fees for your attorney. In the end, the seller will be in this deep for more money than the rifle costs alone. So I think they will come to their sense if you get a lawyer on their tails. Heck, I know of some lawyers, when they write a letter to the offenders, this gets them moving to make a deal.

I am only saying this because I hate SOB who lie via the internet and want them to see that some people will put them in their place if they screw around.

I think that he was merely trying to let us know what Gunbroker username to be aware of; not that this is a Gunbroker-related issue.

Consumers have to hold sellers accountable, otherwise we will end up with anarachy rather than a predictable, legitimate market. I got in a non-shipment problem earlier this year with an outfit out of TX, and only got satisfaction when the local Deputy showed up on the vendor's door. So document everything and pursue appropriate legal action.

FWIW - I almost got ripped off by a guy named Greg Putz (LaPorte, IN) until his local PD contacted him. I had the $$ shortly afterwards. I realize I am a jerk once in awhile...as many of you know...and I can be moron...as many of you know....but...
I emailed the aforementioned subject of this post about a firearm he has on auction ( HARRIS SPORTING LLC GUNBROKER SELLER( bbq05 )...and his response really pissed me off. I can't hold a candle to this guy...on my best day I can't be such a jerk. I can dig my own holes and jump in and ADMITT IT....this guy acts like he is the 2nd COMING.

On gunbroker I went and read nearly all his post's, focusing on the negative posts in his feed back. Every negative post were from buyers with A and A+ ratings -no slouches in this bunch- and in one case the negative post was from a buyer with 30-50 per cent more [NEARLY 700 A+ POSTS] postive posts than this guy[with only 588 postive posts]. The buyer with 700 posts..I'd bet on or buy from but not the subject mentioned here.

His command of the English language is pathetic! Being one STUCK UP, SELF CENTER'd PRIK is a mild description of this guy. I can be a prik but I only do it out of having a sense of annoying those caught up their anger at me...this guy is a NATURAL...

I went and did a search for my post's to this 'thing' even had my secretaries find a cmptr wizzard and who went back into the deep files or what ever you call the heart of this cmptr, but my defragging has them well...hidden or what ever, and they are not retrieveable.

My intent was to post them here and you be the judge.

Yeah... The owner of Harris Sporting is a real prick. I've had a couple telephone conversations with him and wouldn't even consider ever buying from him.

You need to do as the credit card company told you to do period. Send it USPS Insured with delivery confirmation and if he refuses it then document that too.

The credit card company will protect you but you have to play by their rules.

If you dealt with this guy outside of Gunbroker then don't expect Gunbroker to help you... That'd be kinda stupid for them to even consider. You "cheated them out of a profit" by electing to deal with this guy outside of their protective umbrella but you want them to spend valuable resourses to protect you? One other thing... Notify Harris Sporting via certified, return receipt, mail that you will institute legal action for fraud if they don't immediatly refund your money. Put them on notice that you aren't playing. But once again you have to return or at least attempt to return the gun first.

I just sent him an email via one of his auctions. I have looked at several of his deals and almost bought. Glad now I didn't as my morales will not allow me to deal with such people despite them having a good deal or not. If everyone that sees this post would send him and email requesting he settle with his customers disputes perhaps after 1000 or so emails he may or may not "see the light" in dealing via internet honestly. Pretty much boils down to your reputation can make or break you, sometimes the time frame is just a little longer one way or another for different people.

In order to separate the wheat from the chaff he will have to open each email to see whether or not they are complaints or inquiries to his for sale items. Just a suggestion. Don't have to be malicious with emails just state facts. Don't think GB is going to close hundreds of accounts if he complains about improper soliciations!!!! Especially if they find out he is selling off their site also. GB isn't getting it up the hole from encorerb they are getting screwed by Harris the seller for off site sales. So in the end they just may boot his sorry ass.

That won't do a thing. The BATFE is primarily concerned with compliance issues. They won't spend a second of their time getting involved in what is essentially a civil matter.
