As long as several threads are running on this subject I got another question;

In my settlement my ex-wench gets 10G's from my retirement when I retire. The stipulation is that she must keep CSEA informed of her address. I know my ex, she'll never do that. So, what happens to that money if she doesn't? Also, she's 13yrs older than me, what if she dies? Could I file a motion that she has failed in that responcibility and reclaim that money?

Why did you marry her if you know it was going to end in divorce? Just curious, not flamming.

The money is still deducted from the annuity.It will inevitably be an accumulating savings account until she wises up. It does not revert back to you. If you'd like to shut it all down, you might consider a present day value buy-out so that you may receive the entire annuity in the future. If she dies,her beneficiary stuas terminates.

She gets that if she's living. If she dies prior you file a "Notice of death" motion with the court which cutes out any benefits she might recieve. That way it comes back to you...you get to decide how its worked out.

I've seen it done both ways. The younger guys buy their way out. Ex's think their gonna get a boat load of money where in reality they get pennies on the dollar. Older guys say they'll work till their taken out of the plant in a body bag. They hope the ex is gone before they start collecting SS. I worked with a few guys who were in their 70's.
