I have a feeling there's more to the story but If he was given a visa to invest and start a farm and he has caused no trouble he needs to be given a chance to become a citizen, if he over stayed his visa he needs to go yesterday.

Immigration laws are working as intended.
The Minnesota farmer doesn't appear to have applied for citizenship after 5 years in US, as was his right as a law abiding EB5 visa holder. Nor apparently did the sons. FWIW, farmer/sons probably didn't even have to relinquish their Netherlands citizenship, as US does allow dual citizenship.
Sooooo, 18 years later, chickens have come home to roost when the sons turned 21 and are no longer considered dependents.
A tragic, but avoidable situation.
