Without firing the gun and and the threats, he just gets roughed up and tied up. The threats, combined with firing the gun, gets him a dirt nap. Especially if my family was on board.
went fishing with my buddy Davy and little mike onetime. Davy invited another guy mike or didn't know, he was drunk at 5am when he met us at the boat ramp and got drunker as the morning went on. he started fu-cking with little mike, and mikes a small guy about 5.2 maybe 110# other guy 6.2 or so, so after a little while of this and mike threatening to fillet him we put him off on a oil platform about 6 miles out and called the coast guard to go pick him up.

No shooting a captain at sea would be really hard to explain. Witnesses or not.
So they can do whatever they wish, up to and including threatening your life, holding you captive on a vessel you have no control of, and firing a deadly weapon while making those threats?
Not so hard to explain.
Things get even worse if they are in international waters beyond the state controlled waters...

The local cops and F&G deal with some of these matters rather sheepishly, the Coast Guard is a different story and they are doing the investigation. If it's found he is guilty of totally gross violations they will slap him pretty hard. A guy that has a drinking problem as bad as it appears this guy may lays down a history that will work against him. It's been stated over and over he was doing Coke, if he tests positive he's done with his Captains licenses on that alone.
It's mandatory he has insurance so his clients can chase some money for their issues in the case as well, God knows one of the will come outta this with PTSD if they follow a lawyers advice.

His arming himself and making threats to shoot everyone and toss them overboard, and then randomly firing a gun to make his point is more than enough to place anyone on board in fear for their life.
So, yes. I'd kill him without a second thought.

I think the difference is what you were doing is commonly referred to as "near shore" fishing, typically 5 miles or less off shore.
Off shore fishing often constitutes trolling, it takes two, captain never leaves the wheel, boats always moving and the first mate works the fishing gear, teasers, kite's and all the other stuff.
I do book this type of fishing charter, most the time out of Islamorada FL. in the Keys. We troll all day for Sailfish and Marlin as our target species but reel in whatever takes the bait, sometimes a King Mackerel or Bull Dolphin may happen to hit. But it takes two to work the boat, as clients, we pretty much sit back sippin' cocktails until there is a strike. If we are kite fishing, as clients we have to help keep the lines adjusted, 1st mate can't keep up with 4 kites in the air...
