The Tenth Circuit decision in February involving the ordinance has a pretty interesting discussion on equal protection and gender-based distinctions. The City of Fort Collins decided to drop the litigation.

I don't think that this is a correct statement. Fort Collins simply folded. The Tenth Circuit did uphold the preliminary injunction issued by the lower court, but it gave a road map to governing bodies and future litigants concerning the kinds of things that would have to be considered as part of legislation making a gender based distinction.
