I saw your scenario.
I was just further addressing some of the "private property" scenarios.
Lotta folks don't understand the intent angle either. Not sure about Iowa, but some states having the keys in the vehicle while "sleeping it off" has been taken as "intent" to drive. Folks I know have set their keys on a nearby fencepost, or under a rock. But getting in a vehicle, after leaving the bar, and backing it down a driveway sure shows intent to this potential juror.
I'll not convict the girl yet, but as you and a couple of others have pointed out.......... there's likely a whole lot more to the story..........from both sides.

Please post the police officer’s report and videos when you get them. Go ahead and fight it, but I’m willing to bet a friendly little wager that the officers story differs significantly from the story your daughter told her daddy. Should be a good lesson there for all of us on seeing both sides of a story before jumping to conclusions especially when our first reaction is”that’s chickenshït!”.
That being said, I did get my DUI from a cop that watched me pull out of a bar, I blew a .11 just months after Montana dropped to .08. At first I felt it was a BS arrest too, but I was long deserving of it for all the times I had gotten away with near black out drunkenness behind the wheel. And it forced me to straighten up. Did set me back a little bit I moved forward from it as I matured.
Wise Man you are. As if the officer's story can be taken as 100% truth. Odds are high there are three sides to this story, hers, the officers, and then the truth, which none of us will ever know

Well, getting caught ain't too bright. Lots of drunks on here might listen to the folks whose loved ones have been impacted by duii. Don't do it, ever. Not occasionally. Not 8 blocks. None. Nada. Yes private property, on their driveway Here (SD) it's in control of a motor vehicle wherever it might be. Case of a drunk climbing in to sleep it off (so he claimed) - convicted - upheld on appeal. Why you get a a lawyer that knows IA law. And sentencing guidelines.

What we carried in our trucks back then to high school would get a response from the SWAT team TAC Unit with the chopper over head and street blocked off in a 1 mile radius nowadays .

DUI killed our 6yr old daughter.
Young man who hit her was about a mile and half from his home, quarter mile from The Tavern. He never recovered from it. Committed suicide years later.
I commend the cop who stopped her. She may never have to suffer the kind of guilt he did.
A very good atty, defended him and he ended up with a minimal charge.
Lost our daughter. Our whole family deeply scarred. Still evokes STRONG feelings/emotions. Young man's life ruined. Suicide. Probably far more ramifications then I'll ever know.
