Is it legal to drink alcohol and drive? The answer is NO. Period!!! Have I done it? Answer is yes. Am I proud of it like Blackshart ??? Answer is NO!!! Actually I’m ashamed of my lack of judgment and stupidity.

One must wonder why the OP has shared details of the incident, but doesn't reveal the BAC.

Got no sympathy for folks who drive drunk.
This will be a good life lesson for the girl if you let her learn it.
It will likely cost her thousands of dollars. Fortunately it didn't cost anyone else their life. I missed where someone said she was drunk.

I wonder what his probable cause for the stop was I knew a cop that would sit and watch the drunks walk out of a bar, obviously intoxicated. He would wait until they got in their car and start it before arresting them. Thus they were charged with DWI vs being charged with Public Intoxication if he'd arrested them before getting in the car. DWI = Thousands of dollars.
PI = $100 fine.Go figure. He may have saved lives.

But officer discretion can be used...
I don't know how many folks I gave a ride home or let a friend take them home, rather than arrest them for DWI and ruin their career or life. (Both male and female, but mostly young men) The threat of the reality of that happening was enough that I never had problems with any of them again.
Just because it can result in an arrest doesn't mean it SHOULD every single time.
I had a hard time writing a ticket when a warning would serve the situation just as well too...
The case as presented was a prime example where officer discretion would have had a positive effect.
Money probably swapped hands for the drunks to get a pass.
