Read the Constitution, boy, and learn something. It's in plain english. How about you educate us? You have been cucking over at DU too much. The Constitution does NOT speak to what happens if an election doesn't occur. It only speaks about what happens if the President dies, resigns, is removed, etc. The Presidential Succession Act is similar in this regard. I stand by my original analysis, as that is what the Constitution requires.
Eliminate qualified immunity and you'll eliminate cops who act like they are above the law.

(President pro tempore emeritus) Does Chuck Grassley ring a bell? There are 23 republican seats that would expire without an election. There are 13 democratic seats that would expire without an election. This means that the dems hold the majority. The president pro tempore is Leahy, not Grassley, in this case.

If the EC can't elect a president, it goes to the house. If that happens, Trump wins. The catch is that each state gets 1 vote, regardless of population or # of reps, and there are more red states than blue. Right now, Idaho has 2 reps and CA has 53, but they each get 1 vote if it gets that far.

For a long time, there was no popular vote for President. Electors were selected, and they selected the President. We can get a new President without having a popular election.

Except that there wouldn't be a House, as representatives are elected for two years, and their term expires on Jan 3rd. The inauguration and changeover is Jan 20 while it's Jan 3 for congress. Here's a rundown of the procedure. There is no set procedure for the states to select their electors. They can be popularly elected, as is the case in all states right now, but they can also be appointed by the governor or maybe the state legislature. If there was no election, the states would have to quickly figure out how to chose them. Following the national presidential election, which takes place the Tuesday after the first Monday of November, each state counts its popular votes according to that state's laws to designate presidential electors. In forty-eight states, the winner of the plurality of the statewide vote receives all of the electors; in Maine and Nebraska, two electors are assigned in this manner and one elector allocated based on the plurality of votes in each congressional district.[7] Electors are typically required to pledge to vote for the winning candidate, but there is an ongoing legal dispute about whether electors are required to vote as they pledged. State electors meet in their respective state capitals the first Monday after the second Wednesday of December to cast their votes.[8] The results are counted by Congress, where they are tabulated nationally in the first week of January before a joint meeting of the Senate and House of Representatives, presided over by the vice president, acting as president of the Senate.[9] If a majority of votes are not cast for a candidate, the House turns itself into a presidential election session, where one vote is assigned to each of the fifty states, excluding the District of Columbia. The elected president and vice president are inaugurated on January 20.

Again, the problem would be that there wouldn't be any representatives, since all of the current terms end on Jan 3rd. If the election were cancelled, no new reps would be able to take office on Jan 3rd.

In Idaho and many other states, the governor appoints a congressman to fill a vacancy. Other states have special elections. I suspect the supreme court would have to rule on how to fill the seats.
