The Constitution does NOT speak to what happens if an election doesn't occur. It only speaks about what happens if the President dies, resigns, is removed, etc. The Presidential Succession Act is similar in this regard. I stand by my original analysis, as that is what the Constitution requires.

There are 23 republican seats that would expire without an election. There are 13 democratic seats that would expire without an election. This means that the dems hold the majority. The president pro tempore is Leahy, not Grassley, in this case.

If the EC can't elect a president, it goes to the house. If that happens, Trump wins. The catch is that each state gets 1 vote, regardless of population or # of reps, and there are more red states than blue. Right now, Idaho has 2 reps and CA has 53, but they each get 1 vote if it gets that far.

The inauguration and changeover is Jan 20 while it's Jan 3 for congress. Here's a rundown of the procedure. There is no set procedure for the states to select their electors. They can be popularly elected, as is the case in all states right now, but they can also be appointed by the governor or maybe the state legislature. If there was no election, the states would have to quickly figure out how to chose them.

Again, the problem would be that there wouldn't be any representatives, since all of the current terms end on Jan 3rd. If the election were cancelled, no new reps would be able to take office on Jan 3rd.

In Idaho and many other states, the governor appoints a congressman to fill a vacancy. Other states have special elections. I suspect the supreme court would have to rule on how to fill the seats.
