BREAKING: Appeals court orders judge to dismiss charges in Flynn case
A federal appeals court Wednesday ordered a judge to grant the Justice Department its request to drop charges against former national security adviser Michael Flynn.
A three-judge panel on the D.C. Circuit Court of Appeals approved a petition by Flynn's attorneys to intervene in the case after a district court judge asked an outside counsel to argue against the department's request.
Flynn had pleaded guilty to lying to FBI agents in a 2017 interview related to the federal Russia-2016 Trump campaign collusion probe. However, his attorneys withdrew their client's plea earlier this year, following the release of declassified documents suggesting that the agents broke with protocol in the White House interview. Attorney General William Barr asked the court in May to allow it to have the case dismissed.

I wonder what changed. A few weeks ago 2 of the 3 appeals court judges were all for allowing Sullivan to continue this charade.
I gotta think something big came down and the appeals court backed off. We'll see what Sullivan does now that he's cut off at the knees.

The fat lady aint sung yet. No way the full Appeals Court will even look at it. They lost and there is no way to keep it going that does not make them lose more face. Now they can claim he got off on a technicality... Of the 11 members of that court 7 were appointed by Democrats, 4 by Republicans. It takes a majority to hear the case by the entire 11 members (en banc.) So it will take just 6 members to take it to that step. I dont have much faith in the integrity of the 4 Obama and 3 Clinton appointees.

Looking at it from a Commie Democrat viewpoint, which I'm not, I think it would be risky for them to appeal this ruling.
I bet there is a lot more exculpatory evidence to exonerate Flynn than what the DOJ just recently released since they dropped the prosecution.
Rogue liberal judges just might open a whole 'nother can of worms they don't want to see.

The only person who can appeal it is Sullivan. Question is will he. The majority pretty much took apart the dissenting judge's opinion.
