Went to the ABC Store in Gloucester Virginia.

FYI... liquor stores in Virginia are state-owned and run. They are State Property.

I was told I had to wear a mask it was the Law.

I stated I had difficulty breathing with a mask on.

The manager said there are no exceptions it was the Law.

I explained it was not a Law... it was and Order and there were clear exceptions (Google yourself... super easy to find).

Manager told me I had to leave.

At this point... I was in violation of a law... Trespass.

I lost round one... and left.

Subsequent research... I was wrong...

An obscure law in the Virginia code states that I must comply with any Order (Governor) during a time of State Emergency.

It is a tiny misdemeanor, but it does allow arrest.

The Order has very clear exemptions for a multitude of reason... "Difficulty Breathing with a mask on" is at the top of the list.

Round two... my attorney (wearing a mask) and serving as a witness and officer of the court accompanies me for the exact same exchange.

When state services are denied although there are clearly mandated and required accommodations... an arrest would be made and Civil suit would follow...

Do I feel like playing Rosa Parks?

Or should I let "Someone Else" take up the fight for me...

Or simply swing by a friends house and buy another mason jar of the corn.

On a side note... a fat doughboy stuck his nose in the middle of it all... but try as I might... I could not get him to swing on me. I do feel bad now about all the nasty names I called his mother wife and sisters.

You already felt strong enough about it to argue it.... why not make a stand? That is the only way they stay in check.... as long as we lay down, they will walk on us.

No order by a governor can invalidate federal law, even in a time of emergency. ADA is federal law. If you have a condition that prevents you from wearing a mask for medical reasons, ADA is very expansive. If the store will not serve you without a mask you have a lawsuit.

Get a doctor's note and go again.

Phone.and online ordering with in car curbside pickup would be deemed "reasonable accommodation" in a court of law.

Still thinking, but I don't think there is a fight I can win here.

CashisKing, man you seem to be brighter than most guys on here, including myself. I really struggle with the whole mask thing myself around here, but it is mandated by our own supreme being, the newly elected Democratic Governor, also now. Sometimes you just gotta put the mask on, step inside, make your purchase and leave. By the way, I never heard of liquor stores being state owned, can't imagine that. But again, I guess just about everything these days are State and Federal owned when you get down to the nitty gritty. I'm also one who lets my quest for common sense get the best of me before I just realize it's time to just say the hell with it and get along, it's just not worth it sometimes.

Perhaps a move to California is in order.

They sell booze in gas stations, the Rite-Aid, all the grocery store here.

Our county officers are not enforcing our goobernator's mask order.

Come buy booze here, move here permanently, and bring your good conservative values. We need more folks like you.

That question is a clear and total violation of HIPAA regulations and a clear violation of my personal privacy. It comes with a $50,000 + fine for the first offense.

It is also a stackable offense meaning that the fine will increase with each additional occurrence. Example, if employee A from Shenandoah National Park operates a table saw without a blade guard first fine from OSHA is $500. When employee B Gulf Islands National Seashore in Florida commits the same saw violation the fine is now called willful and the fine is $5,000. When employees C does the same thing at Yosemite National Park the ACT is now called deliberately willful and the fine is $50,000.

I may be a little loose with the language and the fine amounts but the overall concept of stackable is accurate.

Very interesting that you could not see the parallel analogy in the situation. The THC levels in Colorado must be truly exceptional.
