What happens if both Senators abstain from the vote.

Does that mean that the quorum is reduced by 2, so the simple majority would be 98/2=49+1=50 votes to confirm and not 51, or is the simple majority based on the total number of Senators 100 no matter what?

It was explained yesterday on Rush's program but I don't think I can do it justice. Basically, you can win the vote with less than 50 votes if there are those who vote "present". if the yes votes outnumber the no votes, its a win. I'll find out details and will post them here later.

When a bill, amendment or in this case, an appointment is up for a vote, a Representative may vote “aye”, “no”, or “present”, which is a refusal to take sides. A “present” vote does not count towards or against the passage of a bill, but it contributes towards the quorum, which is the minimum number of Members required in attendance for the body to conduct business legally.
