If Chevron is reduced and the defining of legislation is given back to the courts then stupid crap like outlawing arm braces and saying you can't collect rainwater off your own roof will end.

The fishing companies came to the Supreme Court, asking the justices to weigh in on the rule itself but also to overrule Chevron. Roman Martinez, representing one group of fishing vessels, told the justices that the Chevron doctrine undermines the duty of courts to say what the law is and violates the federal law governing administrative agencies, which similarly requires courts to undertake a fresh review of legal questions. Under the Chevron doctrine, he observed, even if all nine Supreme Court justices agree that the fishing vessels’ interpretation of federal fishing law is better than the NMFS’s interpretation, they would still be required to defer to the agency’s interpretation as long as it was reasonable. Such a result, Martinez concluded, is “not consistent with the rule of law.”

In a twist of history, chevron was first touted as a victory to stop liberal courts. Now the left has seized executive power as well as the courts.

The agencies were created so Congress would not be held accountable to the citizens they represent for rampant government control of every aspect of our lives.

I painfully watched most of the arguments last night. That Jackson is not all that bright but not stupid either. Kagan and Sotomeyer seemed to want to keep Chevron but the rest felt it was a work around the courts defining the meaning of legislation. Something the Supreme court is supposed to do.
