Tennessee General Assembly is in session and this is the most important thing on the ledger for the second half of the 113th.

HJR 0039 by Rep. Jay Reedy is a proposed constitutional amendment which will when adopted, comport with the Bruen Basis to return the 2nd Amendment analogue specified in the Tennessee Constitution correctly by replacing the Jim Crow era language inserted in 1870 to deny the freed Black slaves the ablitlity to arm themselves against the Night Riders and the KKK with a proper reading of the right.

The original text from 1796 of our then Article 11th § 26 enumeration of the preexisting right was stated as thus; “That the free men of this State have a right to keep and to bear arms for their common defence.” In 1870 the powers that be in Tennessee changed that natural right to read in the now Article 1 Section 26; “That the citizens of this State have a right to keep and to bear arms for their common defense; but the Legislature shall have power, by law, to regulate the wearing of arms with a view to prevent crime.”

In 2010 the Supreme court of the United States incorporated the 2nd Amendment against the states through the due process clause of the 14th Amendment, in effect nullifying that 1870 prescription.

HJR 0038 seeks to put on the ballot in 2026 these words to replace that usurpation penned in 1870 with this simple phraseology “That the citizens of this State have a right to keep, bear, and wear arms.” This secures the rulings in Andrews v. State (TNSC) from 1871, Heller (SCOTUS) 2008, McDonald (SCOTUS) 2010 and Bruen (SCOTUS) 2022.

Currently there are 31 cosponsors of the Resolution in the House; Todd, Sparks, Doggett, Slater, Barrett, Capley, Moody, Grills, Fritts, Cepicky, Martin B, Russell, Littleton, Moon, McCalmon, Keisling, Lamberth, Bulso, Boyd, Gant, Davis, Bricken, Richey, Darby, Hill, Garrett, Farmer, Hurt, Butler, Cochran, Warner to add to Reedy.

This is an issue that must be put before the People for a plebiscite.

Need my Tennessee peeps to contact their state reps and senators. This is an issue that is of vital importance with the way Tennessee is turning Purple at the moment. Nashville, Knoxville, Memphis, Chattanooga and Clarksville are metastasizing like a bad liberal cancer. This will put a stop to their endeavors to de-gun us.

We have a lawsuit that will upset their applecart to a great extent, ruling due the end of this month from a three judge panel seeking a gateway injunction against the state enforcing the requirement of permits to carry in a public park, ancillary argument that the entire state is a gun free zone. 90% sure we win that case, but we need this amendment on the ballot in 2026.

I picked up a couple more House cosponsors over the weekend, but I need to get to 51 for it to be bullet proof.
