I don’t know about New York but when we were “on the clock” we didn’t forfeit our right to speak. I read the article in the OP. I apparently missed where LEO were being involved, since I believe the Bureau under discussion is internal to NYFD. If I'm wrong, I'll apologize I'm advance. I don't agree with the internal witch hunt, but I don't see where NYPD has become involved.

Didn't watch SOTU, but clips I've seen definitely sounded like a campaign speech. But, if we're going to apply that standard half the Congress would be locked up. On second thought.....

It sucks, but your employer should have a certain control of anything you do in a way that affects them. I've seen people fired for criminal behavior, off the clock and not
involving the employer. The things they did became public, and the employer didn't want customers associating the employees actions with them.
Under review by the labor board, the cases I'm aware of were held up and unemployment was denied.

There is considerable case law regarding the free speech rights of public employees. As I understand it, they have the same rights as any other citizens regarding public issues. However, they may be disciplined for public criticism of internal matters, like a letter to the editor claiming the chief is incompetent. The quote in an earlier post citing Dershowitz' opinion seems to be on target. Where whistleblower protection fits in I just don't know. My uneducated guess is that the firefighters in this case were within their rights.
