Gentlemen, I do not like to air dirty laundry in public, however, I feel a need to keep anyone else from getting burnt. I bought a used Winchester Model 70 Classic Super Grade in .30/06' from Phil Pomeroy Quality Firearms via Gunsamerica.com. His ad described the rifle as 98% of original condition. I received the rifle on 4/20/05 and noted normal nicks and scratches befitting a 98% rifle. There was, however, damage to the toe of the stock which had not been mentioned or shown in any of the nine digital photographs he sent. I also noted that the blueing had been ground away from inside the trigger guard. This looked like the removal of the bedded compound. I bought the rifle largely because of the stock figure and had planned to have it rebarreled and bedded. The rifle had also received a do-it-yourself pillar bedding job which made that option less viable. I also noted that the rings and bases were not the Leupold models advertised. I e-mailed Mr. Pomeroy that afternoon explaining that the rifle was not what he had described OR what we had agreed to. I also mentioned the damage to the toe of the stock that was not mentioned in the ad OR shown in any of the nine digital pictures he forwarded. He choose to wait until the third day and my second e-mail to respond. He said the damage to the toe of the stock was "regrettable, but that happens with use." He said he "was not aware of the bedding job.", however, I had "disassembled the rifle without my(his) permission" and the "three day inspection ended" at that time. Hence he would "not accept "the return of this firearm." I think the funniest part of his reply, if it were not soo pathetic, is that he "noticed the mounts and rings were not Leupold when packing the rifle, but didn't think it would be an issue. Besides,�to some,�"Leupold" has become a generic term for describing these parts." I thought that pretty much took the cake. There was evidently quite alot Mr. Pomeroy did not think would matter, however, to me it does. I consider this to be a case of FRAUD... Should any interested party have the desire I have copies of all of the e-mails and should have pictures of the rifle tomorrow afternoon. By all means FEEL FREE TO COPY AND POST THIS ON ANY OTHER FORUM YOU FREQUENT where it would be appropriate. I can only say the entire experience has been a disappointment. This marks the end of my buying weapons from unknown sources via the Internet. In all the years I've worked in this business I've never received a bad check or experienced a fraudulent transaction. That sux. Did you notify the web site? I have been selling on auction arms for some time now (2+YEARS)Still no bad experiances. Did have one bogus bidder give me bad feedback but he is gone and the feedback removed.

The guy is a sleaze bag. A reputable dealer/seller will bend over backwards to make right any dissatisfaction you have. Period!! Don

Matt, sorry to hear about your experience. I emailed him regarding a rifle he had on GA last winter... his reply gave me the impression he was a real ass so I decided not to procede... after reading your experience I'm glad I listened to my hunch...

Sorry to see this happen Matt. I have yet to be burned on a internet gun transaction, but it's experiences like yours that make me less inclined to buy or trade guns over the net. I will say this though, everyone that I have ever bought anything from here at 24hourcampfire has been 100% satisfactory.

Report him as a fraud to the ATF, sit back and watch the fireworks, use the interstate commerce clause. He does live in another state right. Let them go thru and give him a full inspection since he has an FFL. Les

I paid just under $500.00 for a piece of electronics. Long story short, the unit was junk. Seller threw it in a cardboard box and shipped it. No padding, no nothing. I confronted the dealer. NO satisfaction. My question to you is how did you pay for the rifle. If you used a credit card, your card company may be able to help. If you paid using Pay-Pal, they WILL help. It took me about a month, and umpteen emails, BUT Pay-Pal got every nickle back for me INCLUDING shipping and handling charges. Of course before I got my money, I had to return the item. Just a thought. Good luck

If you paid for it by US Postal Money Order, you can file a complaint on the USPS web site. They will deal with the guy, but it may take some time as they are swamped. I've heard of three guys who got screwed and used Money Orders for payment. They did get satisfaction. But, thanks to Matt, he has put the sward to this creep by making it public.. Thanks Matt, Don

I have bought several guns on the internet, most transactions have been excellent, but a couple of minor dissappointments have happened, same thing with Ebay. Buyer Beware, words to live by. If a merchant feels like ripping you off, generally he can.

Firearms fall under a different catagory, as an item that is controlled. They fall under ATF regulations, file a complaint with the ATF, I know that they are not well liked, but they do havwe their uses. I garuntee that this would be the last time he pulls that. Grab the ball and have fun. Les

A few weeks ago I needed a low powered scope and some loading dies, so I went to eBay. I found several scopes offered but got the impression that I was bidding against the sellers. When the bid got to about 60% of new price I quit. I paid new price for a set of obsolete dies($65) that were new in box as advertised. I got two other die sets for semi- obsolete calibers for about $20 each. Both sets as new. I still needed a scope so I started checking out comments about sellers. I found one seller who had a "90%" rating. Further checking revealed that she ran a junk store on eBay with a lot of dissatisfied customers. It appeared that anything that could be broken would be broken on arrival and her response to critical comments was pat and rehearsed So---Buyer Beware--Plan on getting screwed and be pleasantly surprised when you dont

Matt i recieve an email from Guns America everyday with remington, savage, and weatherby, rifles listed that day in it. on the bottom of the list was your beware ad. I believe a lot of people will see it.Good job and good luck getting that deal straightened out. snow
