If the Fed declares that California's Military Memorial cross is unconstitutional, Arlington has to be the next step. Arlington: California memorial cross found unconstitutional "LOS ANGELES (Reuters) A federal appeals court ruled on Tuesday that a San Diego war memorial marked by a four-story-tall Christian cross on public land violates the U.S. constitutional ban on government endorsement of religion. Capping a legal dispute brewing since the late 1980s, the 9th U.S. Circuit Court of Appeals reversed a lower-court decision that threw out a legal challenge to the hilltop cross brought on behalf of Jewish war veterans."

They will just have to put up a Star of David. Same thing has been done elsewhere for the same reason.

Do any of the judges on the 9th U.S. Circuit Court have any common sense? Must be something in the water in California that makes everyone there stupid. Banning crosses in a cemetery? or war memorial? what are they thinking?

Pete E,
Just give it time and that will be the norm. Crosses and stars will be banned.

Pete E,
Just give it time and that will be the norm. Crosses and stars will be banned. I don't think so. The point is if you're going to make a memorial that has a religious symbol, it has to have the symbols for all the religions that fought in that war. That's not overly complicated. Individual graves at Arlington represent the religion of the individual buried there. There would be no cause to remove or adjust that headstone based on any reasonable reading of the constitution.

Looks like the extremist Christians will have to take over the country. What has happened to tolerance?

It's not all crosses, it the 4 story tall one at Mount Soledad that is in question. The grave markers aren't the crosses in question.

It came out of the 9th Circuit. Does anything else need to be said?

I guess I fail to see how that ruling affects the cemetery markers at Arlington or any where else for that matter. Each soldier is buried under grave marker of his/her choice. I know soldiers now buried under the pentagram for Wiccans and Witches. I also understand the Yin and Yang symbol is also used on grave markers.

I thought that cross was on private property. It was purchased by a private party. It is now maintained by the owner and not tax dollars.
My wife was there in October of 2010 and read the sign stating it was privately owned and maintained the cross.
I am thinking this is a non issue.

News this evening said it was city or county (not sure which) property deeded to the feds. No idea who owns the cross or mantains it. or if the news was correct for that matter.

From: http://www.sddt.com/news/article.cfm?SourceCode=20110104czg"This result does not mean that the memorial could not be modified to pass constitutional muster nor does it mean that no cross can be part of this veterans' memorial," she wrote. The case now returns to the trial court to decide how to remedy the memorial's unconstitutionality. ... Two Vietnam War veterans initially sued the city in 1989 to remove the cross from city land. Following much legal wrangling in both state and federal court and a pair of ballot measures, the U.S. government seized the property by eminent domain in 2006.

The ruling is against religious symbols on government property. That would encompass Arlington, my friend. They don't call it "Ninth Circus Court" for nothing.
