Salisbury man banned from hunting worldwide

A Salisbury resident has been banned from hunting anywhere in the world for two years as part of an agreement with federal authorities in Kentucky on charges that he illegally hunted in and took wildlife from that state.

Rodney L. Poteat agreed to the ban in U.S. District Court in Kentucky last week, according to a Department of Justice press release. Reached at his Perryman Drive home Wednesday evening, Poteat declined to comment.

He also agreed to pay the Kentucky Department of Fish and Wildlife Resources $5,300 in restitution, and $50 in special penalty assessments. The restitution is to compensate the Kentucky Department of Fish and Wildlife Resources for the fees Poteat would have paid for hunting in Kentucky between 2002 and 2011, the press release said.

Poteat was charged July 27 and sentenced Sept. 7. He received unsupervised probation. The hunting ban was a condition of that sentence, Justice Department statement said.

According to federal authorities, on Nov. 27, 2010, Poteat transported a 14-point white-tailed deer from Hart County, Ky. to his home in Salisbury. Poteat was required to purchase a non-resident hunting license and deer permit prior to hunting in Kentucky. He also was required to report the harvest of any deer taken in Kentucky, and to make a report before transporting the deer outside of Kentucky.

Poteat also pleaded guilty to knowingly transporting a bobcat from Hart County, Ky. to Salisbury in November 2010 without purchasing a non-resident hunting license. Poteat also failed to report the harvest of a bobcat taken within Kentucky, authorities said.

According to the press release, Poteat used to live in Hart County, Ky.

IMO we need to absolutely crush poachers, and people who trespass to take game and such!

while i applaud the judge for hanging it on this man, in cases such as this, i don't believe american authority (or legal rulings) extend to foreign countries unless an extradiction agreement exists, and i don't see this particular ruling being enforced ever. i'm sure the guy could go to south america and hunt till he dies of old age. good initiative, but poor judgement.

Since the article states the man is on probation - the article doesn't say how long but I would guess at least two years - upholding the terms of probation is his responsibility, not the responsibility of any foreign government. If he violates the terms of his probation, he would be subject to further penalties, probably including jail/prison. Yes, he could skip the country and break his probation, but if he ever decided to return to the U.S. he would probably end up in prison for a while.

It's hard to get excited over deer poaching.The Interstates around here are covered in dead deer and we've yet to see any season closures as a result. Poaching is like DUI,it's been lifted off the courts back burner and placed up front because it makes money.

The man shot the animals in Kentucky and brought them back to NC, thus it falls under "interstate commerce" or some such, and so the Feds are the ones prosecuting. The Feds are only supposed to step in where crimes cross state lines.

Hey Dober I sort disagree on the trespassing.Some one doing it blaitnly(sp) yes, but sometimes land isn't marked very well even in/or around Natl'forest.
As for poaches they should get the screws put to them.

no just like a bar can serve someone who isnt supposed to be drinking while on parole but if your caught doing it and it gets back to your parole officer you will be in deep chit....part of parole is showing you can police yourself....if yah cant do that they throw your arse in jail....

Well that is interesting "How do you Enforce it"? As for poaching a White Tail, here in CT, in East Haddam, as land owner I get two tags, I do not have to go to a check station, I file on line. If I go to a check station, they will give me another tag. It seems that we have a bit of an over Population of deer here. I think nobody would get to upset if you shot one out of season, I know of a fellow that is in real bad shape due to unemployment and no transport other that his feet. Lives about 5 miles from me. He stopped by and asked me if I could spare two rounds of 30-06 so he can get some meat soon. I don't shoot an 30-06. I am thinking of buying him a box, I have enough for some Federal Blue Box! I had people ask for money, this is a first for ammo. Living off the land I guess, in CT of all places.

BBJ-I totally concur, I also feel that sportsman and landowners should do their level best to ensure boundry's are understood. Some of the bigger ranches I know of do a wonderful job of posting their land so people would have a really hard of not knowing where they were at. If...I had a ranch I'd make sure that the signs were new, fresh and legible yearly and no doubt left. Would love to see the landowners step up and have their land posted if they didn't want people on it. But, that's just the way I see it.

Helping patrol a place in your AO Dober and one of the guys came up with a good idea...put your signs 10 feet above the ground and very visible...otherwise the bastids tear them down on day one and claim to have seen no posted signs....
