The issue of constitutionality wasn't addressed in the order. That will be addressed at a later date. The issue is whether Trump's act could cause immediate irreparable harm to the public in those cities. This judge found that such harm was likely.
Trumps legal team will have their day in court on this down the line. Just not today.
