Unions don't get to pick and choose which cases they will pursue, at least not arbitrarily. They have a legal obligation called the Duty of Fair Representation. If they deliberately fail to diligently represent an employee, they can be sued.

In times past a union might not push an employee's grievance if they thought said employee was an a-hole. That changed, and I have seen them push a grievance even though the union rep clearly didn't want to. "I know he's an a-hole, Paul, but I have to represent him with his grievance."
