The Sierra Matchking does not expand like a soft point at the ranges it is used by military snipers. In order to make it expand, you need an impact velocity of 2300 fps or more.
Because it is used at extended ranges, and impacts at a much lower velocity than that, the Military JAG's determined that it is not, as it was used, an expanding bullet under the accords. E
