Your legal hypothesis that " his future was dictated by his past actions", doesn't work in this state. Colorado law is clear, if your opponent disengages from the conflict, you have to stop all aggressive action. If you continue, you are now the aggressor, and the one who will need a good attorney.



Not a legal hypothesis at all, normal human reaction to a known threat. The aggression did not stop until the shooting commenced and was finalized in a couple of seconds. The question remains, what would you do if attacked in a similar manner? And yes I have a very good lawyer, and avoid Colorado.

When now Congressman Ken Buck was the Weld County DA he declined to prosecute a shooter who killed a man on his front porch making threats and carrying a stick, apparently because he was in fear for his life.

Friend here is a local fireman / EMT
Couple of years back he arrived at a scene where a bad guy had gotten shot 7 times with 45 acp FMJ ammo. He said the guy was still on his feet when they arrived and that they had to make him lie down on the stretcher.
He also said the same guy was out of the hospital in one week. 2 shots hit the guy in the stomach and one in the lower back area. Guess some folks are just damn lucky!!!!

Where I live, I don't want to kill anyone.
Or anywhere.

That man was no immediate threat to anyone yet.
A little standoff distance, call for backup, it probably could have been handled
better and safer for everyone.

But, with the cop that close, the first shots will be justified.
The last couple? Quite possibly.
Once you engage, things are a bit different than before the first actions.


Honestly, like a lot of these shootings lately,
The cop may be cleared for the shooting.

The question?
Based on their decisions leading up to the need to shoot,
should they be cops anymore?

Perhaps this was a good shoot......perhaps not. I don’t know the whole story. That said, I do get tired of all the piss poor behavior going on. You swing a bit stick, or whatever, at a cop, then you better be ready for some retaliation.

I found a still of a female officer holding the "pipe" up with one hand, looks to be a light thin metal.
I couldn't weight much the way she is holding it.
