Very good attorney told my brother never take a breathalyzer. He said he can get you off if you don’t but you’re likely screwed if you do. I'd imagine most attorneys would advise the same, but it's extremely dependent on the Court/Judge as well as the officers involved. I had a Judge for a long time that, once you established yourself in his Court, saw refusals basically as a 'dodge'. In his Court, attorneys pled a lot of refusals they probably wouldn't have elsewhere.

I left the drive in theatre when I was 18 with the GF. Speeding like a dumbass got pulled over. They said they give 3 breathalyzers because they’re not that accurate (per the popo)

Never. For the last 20 years on the job we had to had to have a class B CDL and the blood alcohol drops to .04. Some guys beat it in court by claiming it was a job requirement and they weren't assigned as engineer/apparatus operators. That was changed and it got ugly for some guys that just couldn't get it right. I know a guy that got a DUI just moving his car from a condo parking lot to the street. The cop observed him and his friends exiting a limo after a bachelor party. My wife did all the driving back then. She figured even of she got caught I (The Meal Ticket) could keep working. The first DUI was a 30 day suspension. 2nd was 6 months, 3rd was a termination.

There was a local guy around here that the state said had 27 (TWENTY SEVEN) DWI's that they knew of. He got busted here leaving the local bar after telling the bartender "They'll never take me alive" and then drove off on a motorcycle. Guess he was wrong on that call He got one a couple towns over after driving off with the gas pump hose still in his tank. The last one I heard of he left the local VFW and got stopped on a major hiway going 10 mph, which I suppose was good? He just passed away not long ago.

In his Court, attorneys pled a lot of refusals they probably wouldn't have elsewhere. What did they do if their client blew a 1.04? Generally that would lead to a plea as well. Either I would drop the administrative portion and they'd take the DWI (assuming we're discussing a first offense) or I'd reduce to a Reckless and they ate the administrative. Obviously, prior records etc played into the negotiation The first portion of my career, a first offense was violation level. That made things a lot easier for all parties.

Nope, because I quit alcohol about 1980.... no alcoholic problems, in fact had a high tolerance for it...
the fines and all the BS over a DWI just wasn't worth it...but I've never had one...
I just drank soft drinks at something social....

I worked in a factory. Amazing how many raging alcoholics avoided DUI.
Some got popped after 20 yrs of drinking and driving.
The ones that partied and rode motorcycles, some of them got splattered.
Honestly, cell phone dumbassery seems more deadly.

A drunk killed my friends wife when he head on’d them in a curve. The drunk received his 7th DUI. He is in prison now for a long time.

Guy I used to work with lost his license repeatedly, did jail time. He once got caught driving his riding mower to the bar. Scumbag once begged his co-workers for money "for his daughter's birthday present". One guy gave him $10, and he went straight to the bar with it. He ded now.

For 35 years there was hardly a day that went by that I wasn’t eligible for a DUI but I never got one. Way back before the cars had breathalyzers I passed a field sobriety test with a fifth of Jim Beam in me. Health has forced me to quit drinking altogether now
