Okay, so what happens if the judge grants the mistrial motion for the defense? A new trial? That doesn’t seem to benefit Kyle.

Easy when you are innocent.

Not easy for everyone knowing what's at stake even when innocent

This is very true. The stakes are unbelievably high. Kyle already has to live with what happened for the rest of his life. But he is risking time in prison, like most of his life. Even a short time, like a year, would end his career, set back any education etc. It flips a switch and restarts your life, with you way behind! He would have a felony which makes job opportunities harder, people would forever view him differently, it would be a mess all around. Anything he had financed would likely be gone. Any savings would be gone from fines and living for a few years during the trial and prison without income. There is a ton of long term affects, some take place even if he is found innocent.

I doubt the judge would do that. There are two reasons. That would tend to support the tomfoolery of the prosecution and enough facts have been presented to make it obvious it was a clear case of self-defense. Mistrial with prejudice perhaps.

Yep, very risky...especially if you keep saying "I don't recall" & "I don't know".

I cant stand that line of thinking. Nobody should do anything, just call 911. Its a lame tactic that makes everyone think someone else could have dealt with this. Not everyone in the United States is a little weanie that needs someone else to take care of little things. What is wrong with a person trying to stop a burning dumpster from becoming a worse problem?

They asked for a mistrial with prejudice, which means the prosecution can’t refile charges against Rittenhouse. Defense attorney made the motion and stated the prosecution was trying to create a mistrial because their case was going so badly and wanted a new trial. The “with prejudice “ would end it.

If it's with prejudice, then that's the end.

Thanks for the clarification.

Seems reasonable.

That prosecutor is doing a great of bringing sympathy for Rittenhouse with his continuous attacks on him, I hope that pos Binger gets disbarred.

That's ok, I'll ass shoot a dink.
