NOGALES (AP) — Santa Cruz County prosecutors headed back to court Monday afternoon and announced they will not retry George Alan Kelly for the fatal shooting of a migrant last year.
Kelly, a Santa Cruz County rancher, was accused of killing 48-year-old Gabriel Cuen-Buitimea near Nogales on Jan. 30, 2023.
The jury in Kelly’s first trial was deadlocked last week over whether or not to convict him on charges of second-degree murder and aggravated assault.
The jury went through two days of deliberations, but could not reach a unanimous verdict so Santa Cruz County Superior Court Judge Thomas Fink declared a mistrial on April 22.
In court today, April 29, the judge stated an official motion to dismiss must be filed, but he would grant that motion.
13 News learned the jury, made up of five men and three women, voted 7-1 to not convict Kelly. The rancher’s attorney said the fact seven people wanted to find him innocent should be a clear message to the state that another trial would not be a good idea.

There were protesters outside the courthouse demanding a retrial. A local reporter interviewed a protester with a retrial sign who made it clear that he didn't even know what Kelley had been charged with or what the trial was about.

There were protesters outside the courthouse demanding a retrial. A local reporter interviewed a protester with a retrial sign who made it clear that he didn't even know what Kelley had been charged with or what the trial was about. And that would be par for the course.

I have a good number of Mexican friends here who work on our large farms. 90%+ say they cross over in Arizona, not Texas, for whatever reason.

Glad to see he is free! This was a bogus indictment form the beginning. Somebody needs to set up a GOFUNDME to buy him a backhoe for disposing of future trespassers.
