Pogue and Elims were doing what they were paid to do.
Dallas was in fact poaching and in possession of hanging venison and bobcat pelts.
Likely it was Elim walking out of Claudes tent with the bobcat pelts that distracted Pogue and gave Dallas the opportunity to shoot him.
Though Pogue had a reputation of a jerk,others would say no nonsense, and the defense played it for all it was worth.
Talk is that Pogue had it in for Claude but they had never interacted other than Pogue leaving his business card in a illegal trap of Dallas's, that he didn't know was Dallas's.
He didn't know it was 'Claude Dallas" in that camp that day.
AIR, Pogue wasn't in that camp before but glassed and noted it after responding to rancher's report of a illegal trap baited with sage hen.
Then came the report from the rancher's son after riding through the camp that initiated that day.
Hell, the day before a acquaintance of Dallas's was rattled when he rode into that camp and ended up looking down Dallas's muzzle before Dallas recognized him.
Tells you something of Dallas's mind set.

But you're correct, Claude was convicted of murder (wrongfully imo) served his time, paid his "debt" and I hope lives his days out in happiness. Something I'm glad Pogue doesn't get to do.
