The promise of “up to” means that the employee worked 40 hours a week and didn’t miss any work AND did NOT pick up OT. If you’re out of work 2 weeks total all year you weren’t accruing sick leave because you weren’t working. You typically don’t accrue PTO or sick leave when you aren’t working so the “up to” is literally up to the employee and assumes ideal circumstances.
