Yes...especially the below.... Democrats will find a judge in the Ninth Circuit who believes that a district court judge has the power to overrule the statutory authority clearly granted to the president to declare a national emergency. What happens then? I think it is quite possible that the Trump administration will appeal directly to the SCOTUS, bypassing the Ninth in the name of a national emergency. He might even decide to take a stand against the new concept of district court jurisdiction over the entire United States. Good point. District Court decisions against Federal action should only negate the actions of the Federal Government within that district. The only Appellate decisions that should affect Federal action within the entire nation are those from the Supreme Court.

I could be wrong but I see it as Mr Trump pushing an ailing America slumped in a wheelchair down a narrow corridor flanked by burning hot walls which are being fed by those on the left. Were I in that chair I would be keeping still and attempting to make his task easier.

If the president does decide to declare a national emergency, I wish his team would adopt the tactic that I've heard the Obamaists used and get someone to file suit against his executive order quickly in a court that would likely uphold Trump. You know, kind of a fake attack that would fail and then the army could proceed to build the barrier unimpeded by the courts. The reason this wall is being opposed is twofold, one it would work, and Trump must be driven from office.

Interesting read this, but I am of the opinion that you lot seem to have a problem staying the course and backing your team.
And a lot of you seem too quick to bail.
To be clear, Trump isn't "my team". Trump is an uber-wealthy NYC business democrat who believes in big government, gun control, and business as usual for the corrupt system of laws known as "corporate law". I believe the smaller and more bereft of resources a government is, the better. The US Government has gone from protecting rights and property to stealing rights and property at will. Trump is by definition a traitor in his attempts to enforce current gun laws on the books, even though the Constitution denies him any such power. Trump was NOT Hillary. That was the one factor required for him to get my grudging support. Yet he let her walk as well, though she has committed more felonies than MS13.

As long as he does the National Emergency thing he'll be alright I hope he issues the order for the wall on his authority as CIC, and orders the complete construction (apart from extremely rough terrain, which areas are not prone to illegal entry), not just part. Funding is something that should be dealt with after construction is complete, as is done with the cost of missile barrages into Syria. PS A real wall, like we were promised, not steel bars that can just be hack-sawed through.

But then, I’ve walked a post before. In fact, one of the few in the Marine Corps at the time which was NOT a chlallenging post..... see them- shoot them. It was the Atomic Ordnance Post at 29 Palms and it had a chain link fence around it. One sentry patrolling inside with a shotgun and one in an armored guardhouse just outside the enclosure with an M 14 and a 45. And it was only a ten minute Jeep ride from the Guardshack.

I think they call that political suicide....A lot of Dems own guns too... Trump is fighting a battle over a wall that a lot of Dems have agreed to in the recent past. They are just posturing at the moment because they dont wont to give him a big win, but when it comes down to it, they know border security is a huge issue in this country that is not going to go away anytime soon. At least most of them know it, I think. If the Republicans agree to give the DACA kids amnesty, the Dems are going to be put in a real tough position themselves to downvote Trumps wall or barrier or whatever they call it. How can they go to their base and explain why they downvoted amnesty for those kids over a wall that is needed when they have been fighting for amnesty for them for years? Especially when Trump has made concessions and doesn't even want the big, shiny concrete sea to sea wall anymore...

Firearms are constitutionally protected ( somewhat ) a wall isn't. If guns laws could have been done with the stroke of a pen the last administration would have done that.

As disappointed as I am at Trump giving in to Pelosi........and make no mistake about it, that's exactly what happened despite what the Trumpkins say to the otherwise, I am forever grateful that Hillary is not president and that Trump hopefully has the chance to make a third choice to the SCOTUS.

That would not be nonjusticiable (look it up in the context of political question doctrine), so the courts would be obliged to stop such an action based on the Constitutional protections it violates. Not so with the president's delegated power and duty, under that very same document, to defend the border against invasion by whatever means necessary, and without the Constitutional necessity for the approval of either of the other two coequal (look that up, too) branches of government.
