the issue is whether the rationale of Heller, which only dealt with the federal government's ability to regulate firearms, would be binding on the states as well. the Bill of Rights limits the powers of the federal government, but only limits state governments to the extent that its provisions were "incorporated" under the due process clause or the privileges and immunities clause of the fourteenth amendment.

By incorporating rights from the Bill of Rights in the fourteenth amendment's guarantees, they become explicit restrictions on the power of the states as well.
