I had a Judge for a long time that, once you established yourself in his Court, saw refusals basically as a 'dodge'. In his Court, attorneys pled a lot of refusals they probably wouldn't have elsewhere.


What did they do if their client blew a 1.04?

Generally that would lead to a plea as well. Either I would drop the administrative portion and they'd take the DWI (assuming we're discussing a first offense) or I'd reduce to a Reckless and they ate the administrative. Obviously, prior records etc played into the negotiation
The first portion of my career, a first offense was violation level. That made things a lot easier for all parties.
