They can't. This is a message to everyone else. Defend yourself and you will be prosecuted to the fullest extent of the law.
Yeah they over charged him for the message but also, as with the police who arrested Floyd, the overcharge will result in them being set free after their lives are ruined so more excuses for looting rioting and general mayhem. Win/win.
I can see that, now that you describe it. It makes sense according to the larger narrative. Greater and greater unrest in perpetuity.
