Just because the fence isn't on the property line doesn't mean you have ceded that property to the neighbor. Sometimes it is good to have access to both sides of a structure which couldn't necessarily be done if workers had to stand in Mexico to do it. When I couldn't get my neighbor to cost share on a line fence I pulled off line 21 feet and built a fence, then I planted trees on my 21 feet and requested that his cows not graze my little trees. But getting back to the subject, we could hardly build a barrier down the middle of the river.
